WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

We collect personal information that you voluntarily provide to us when you register on the Sites, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Sites or otherwise when you contact us.

The personal information that we collect depends on the context of your interactions with us and the Sites, the choices you make and the products and features you use. The personal information we collect may include the following:

Personal Information Provided by You. We collect names, phone numbers, email addresses, mailing addresses, usernames, passwords, contact preferences, contact or authentication data, billing addresses, debit/credit card numbers, and other similar information.  We also collect information you provide to us by filling in forms on the Website and App (including the Contact webpage), as well as records and copies of correspondence you send to us.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

We automatically collect certain information when you visit, use, or navigate the Website or App. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about who and when you use our Sites, and other technical information. This information is primarily needed to maintain the security and operation of our Sites, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies, web beacons, and similar technologies.

The information we collect includes:

  • Log and Usage Data. Log and usage data is service-related, diagnostic usage, and performance information our servers automatically collect when you access or use our Website and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type and settings and information about your activity in the Website or App (such as the date/time stamps associated with your usage, pages and files viewed, searches and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called ‘crash dumps’) and hardware settings).
  • Cookies. We use cookies and similar tracking technologies (like web beacons ) to access or store information. A “cookie” is a small file placed on the hard drive of your computer.  You may refuse to accept browser cookies by activating the appropriate setting on your browser.  However, if you select this setting you may be unable to access certain parts of our Website.  Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the Website. A “web beacon” is a small visible or invisible digital image that allows us to count visitors to our Website.  Web beacons collect limited information including cookie number, time and date of a page view, and a description of the page on which the web beacon resides.  The information we collect automatically helps us to improve the Sites.
  • Device Data. We collect device data such as information about your computer, phone, tablet or other device you use to access the Sites. Depending on the device used, this device data may include information such as your IP address (or proxy server), device application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system configuration information. 
  • Location Data. We collect information data such as information about your device’s location, which can be either precise or imprecise. How much information we collect depends on the type of settings of the device you use to access the Website. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Locations settings on your device. Note however, if you choose to opt out, you may not be able to use certain aspects of the Services.

 

HOW DO WE USE YOUR INFORMATION?

HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

 

HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. Although we will endeavor to protect your personal information, transmission of personal information to and from our Website is at your own risk. In addition, you should only access the Website within a secure environment.

 

LINKS TO OTHER WEB SITES AND SERVICES

Our Sites may contain links to and from third party websites of our business partners, advertisers, and social media sites. As such, our privacy policy does not apply to other advertisers or websites. Thus, we advise you to consult the respective privacy policies of these third party entities for more detailed information. It may include their practices and instructions governing those third parties’ uses of your personal information. 

 

DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly solicit data from or market to children under 18 years of age. By using the Sites, you represent that you are at least 18 years of age or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Sites. If we learn that personal information from users less than 18 years of age has been collected, we will take reasonable measures to promptly delete such data from our records. NOTICE TO NON-US RESIDENTS

The Sites are also not intended for persons not resident in the U.S. Nonetheless, users outside of the United States are advised that the Sites and the services advertised on the Sites are targeted for users in California and Nevada, United States of America.  Please be aware that if you are located in the European Union, the United Kingdom, Canada or elsewhere outside of the United States, any information you enter on the Sites will be transferred outside of the country where you are to the United States of America, which may not offer an equivalent level of protection to that required in the country where you reside.  European Union residents, in particular, are advised that the United States of America uses a sectoral model of privacy protection that relies on a mix of legislation, governmental regulation, and self-regulation.  Article 26 of the European Union’s Data Protection Directive (Directive 95/46/EC, 1995 O.J. (L 281) 31) allows for transfer of personal data from the European Union to a third country if the individual has unambiguously given his consent to the transfer of personal information, regardless of the third country’s level of protection.  By using the Sites or by contacting us through a contact form, you consent to the transfer of all such information to the United States of America which may not offer an equivalent level of protection to that required in the European Union and to the processing of that information by us on our servers located in the United States of America in accordance with this Privacy Policy.

PRIVACY OPTIONS RELATED TO MOBILE MESSAGING

 

User Opt In: The App allows users to receive mobile text messages by affirmatively opting into the receipt of such messages, such as through online or application-based enrollment forms or by texting a keyword to any successor short code(s) we may send to you through the App.  Regardless of the opt-in method you utilized , you agree that this Privacy Policy and its accompanying Terms of Use apply to your use of the App.  By using the App, you agree to receive  marketing text messages at the phone number associated with your opt-in, and you understand that consent is not required to make any purchase from us.  Message and data rates may apply.

User Opt Out: If you do not wish to continue receiving text message on your mobile device or messages through the App, or no longer agree to these Terms, you agree to reply “STOP,” “QUIT,” “END,” “CANCEL,” “UNSUBSCRIBE,” or “STOP ALL” to any mobile message from us.  You may receive an additional mobile message confirming your decision to opt out. Alternatively, you may opt out via email at [email protected] or our contact form at pizzaguys.com/contact-us.  You understand and agree that the foregoing options are the only reasonable methods of opting out.  You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list are not reasonable means of opting out.

Duty to Notify and Indemnify: If at any time you intend to stop using the mobile telephone number associated with your use of the App, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the User Opt Out process set forth above prior to ending your use of the mobile telephone number.  You understand and agree that your agreement to do so is a material part of this Privacy Policy and its accompanying Terms of Use. You further agree that, if you discontinue the use of your mobile telephone number without notifying us of such change, you agree that you will be responsible for all costs (including attorneys’ fees) and liabilities incurred by us, or any party that assists in the delivery of the mobile messages, as a result of claims brought by the individual(s) who is later assigned that mobile telephone number.  This duty and agreement shall survive any cancellation or termination of your use of our App or any of our Services.

YOU AGREE THAT YOU SHALL INDEMNIFY, DEFEND, AND HOLD US, OUR AGENTS, AND ANY THIRD-PARTY SERVICE PROVIDER WE USE TO SEND TEXT MESSAGES HARMLESS FROM ANY CLAIM OR LIABILITY RESULTING FROM YOUR FAILURE TO NOTIFY US OF A CHANGE IN THE INFORMATION YOU HAVE PROVIDED, INCLUDING, BUT NOT LIMITED TO, ANY CLAIM OR LIABILITY UNDER THE TELEPHONE CONSUMER PROTECTION ACT, 47 U.S.C. § 227, et seq., OR SIMILAR STATE AND FEDERAL LAWS, AND ANY REGULATIONS PROMULGATED THEREUNDER RESULTING FROM US ATTEMPTING TO CONTACT YOU AT THE MOBILE TELEPHONE NUMBER YOU PROVIDED.

Program Description: Without limiting the scope of this Privacy Policy, users that opt into the use of the App can expect to receive text messages concerning our commercial activities and your relationship with us, including, but not limited to, messages concerning product advertisements and promotions of any kind, your account information, and your orders from us or our third party fulfillment partners.

Cost and Frequency: Message and data rates may apply. Usage of the App involves recurring mobile messages, and additional mobile messages may be sent periodically based on your interaction with us.

MMS Disclosure: The Program will send SMS TMs (terminating messages) if your mobile device does not support MMS messaging.

Our Warranty: We will not be liable for any delays or failures in the receipt of any mobile messages sent to or received from you during your use of the App. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator, and is outside of our control. 

DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

 

  1. California Right to Opt Out

California residents have the right to opt-out of our sale of their Personal Information (“PI”) to third parties. If you are a California resident, you may exercise your right to opt-out of our sale of your personal information to third parties by:

  •                     Completing the form on our Do Not Sell My Personal Information webpage at https://www.pizzaguys.com/about/not-sell-personal-information/; or
  •                     Sending an opt-out request in writing to [email protected] with the subject line “Request to Opt-Out” and a description in the body of the email of the marketing or other use of the Information from which you would like to opt-out; or
  •                     Sending an opt-out request in writing via U.S. mail to: Pizza Guys Franchises, Inc., 2731 Citrus Rd. A, Rancho Cordova, CA 95742.

If you receive offers or other communications from our third party marketing partners and would like to opt-out from future communications from them, you must contact them directly. In general, it takes up to 10 days for an Opt-Out request to take effect, but may sometimes take longer. A third party’s use of your personal information is subject to their privacy policy.

We may request authentication or verification of your request to opt-out, for example, by requesting that you re-enter your email address or other PI, by requiring authorized agents of a user to provide additional PI of the user and authorizing documents to confirm their authorization by the user, or by sending a confirmation email to a you that you must confirm prior to the Opt-Out request taking effect.

Users may opt out from the collection of online viewing data for behavioral advertising purposes by companies who have elected to participate in one of the behavioral advertising opt-out mechanisms such as the Digital Advertising Alliance’s opt-out program. As is the case with most websites, we have not elected to participate in any of these programs at this time, and such opt-outs will not constitute an Opt-Out request under this Policy.

You may disable cookies, web beacons, and other technological means placed by our Affiliates and third party partners by adjusting their browser or email client settings. You may also opt out from the collection of online viewing data for analytics purposes performed by Google Analytics by going to Ad Settings under your Google account. As noted above, we may identify you by your email address, third party cookies, or other means, and will use these methods to tailor your experience on our Sites if you visit our Sites or one of our Affiliate’s sites in the future.

  1. California Right to Know

California users have a right to request disclosure of certain PI we have stored about them over the past 12 months. California users may request this disclosure by contacting us through our Website at https://www.pizzaguys.com/contact-us, via email at [email protected] with the subject line “Request to Know”, or by sending a letter to our postal address below with the same request. Once we receive and confirm your verifiable user request, we will disclose to you:

  •                     The categories of personal information we collected about you.
  •                     The categories of sources for the personal information we collected about you.
  •                     Our business or commercial purpose for collecting or selling that personal information.
  •                     The categories of third parties with whom we have shared that personal information.
  •                     Certain allowable specific pieces of personal information we collected about you (also called a data portability request).
  •                     If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
  •                     sales, identifying the personal information categories that each category of recipient purchased; and

  1. California Right to Delete

California Users have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable User request, we will delete (and direct our service providers to delete) your personal information from our (their) records, unless an exception applies; provided, however, that in some cases, strictly for regulatory compliance purposes and to better evidence/honor opt-out/unsubscribe requests (and for no other purposes), we may retain certain items of your personal information on a de-identified and aggregated basis in such a manner that the data no longer identifies you.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  •                     Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our obligations in connection with our contract with you.
  •                     Detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity, or prosecute those responsible for such activities.
  •                     Debug products to identify and repair errors that impair existing intended functionality.
  •                     Exercise free speech rights, ensure the right of another user to exercise her/his free speech rights or exercise another right provided for by law.
  •                     Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  •                     Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, but only if you previously provided informed consent.
  •                     Enable solely internal uses that are reasonably aligned with user expectations based on your relationship with us.
  •                     Comply with a legal obligation.
  •                     Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
  1.   California Right to Correct

California users have the right to request that we correct inaccurate personal information that we may maintain about you, such as your name, mailing address, email address, phone number, age, and gender.

  1. Exercising California Access and Deletion Rights

For California residents to exercise their access, deletion, and/or correction rights described above, please submit a verifiable user request to us by either:

Only a California resident or a person registered with the California Secretary of State that is authorized by a California resident to act on their behalf may make a verifiable California user request related to their personal information. An authorized agent may make a request on your behalf by contacting us at [email protected] with the subject “Proxy Request” together with detailed information about you.  Please note that we will take steps to verify any such request with you, and may deny the request if it cannot be verified.

California residents may only make a verifiable user request for access twice within a 12-month period. The verifiable user request must:

  •                     Provide sufficient information that allows us to reasonably verify that you are: (1) the California resident about whom we collected personal information; or (2) an authorized representative; and
  •                     Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. Making a verifiable user request does not require you to create an account with us. We will only use personal information provided in a verifiable user request to verify the requestor’s identity or authority to make the request.

California Users may designate an authorized agent under the CCPA to act on their behalf by sending a letter to the email or postal addresses above with a signed letter that includes the name, email address, and date of birth of the user for verification, along with either the user’s signed designation of the authorized agent or a court order or similar legal document designating the authorized agent as acting for the user (for example, a power of attorney or letters testamentary).

  1. Response Timing and Format

We endeavor to respond to all verifiable user requests within forty-five (45) days of the receipt thereof. If we require more time (up to ninety (90) days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the twelve (12) month period preceding the receipt of your verifiable request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable user request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

  1. Non-Discrimination

We will not discriminate against California residents for exercising any of their privacy rights set forth above. In particular, we will not:

  •                     Deny you goods or services;
  •                     Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;

According to Nevada law, Nevada residents are permitted to opt out of future sales of certain personal information.
